These Terms & Conditions (“Terms”) govern your use of getwelltide.com (the “Site”) and any purchase from Welltide (“Welltide”, “we”, “us”, “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
1. Research use only
All products sold by Welltide are intended strictly for in vitro laboratory research. They are not intended for human or veterinary use, consumption, injection, diagnosis, treatment, cure or prevention of any disease. They are not drugs, foods, dietary supplements or cosmetics, and they have not been evaluated by the U.S. Food and Drug Administration.
By ordering, you confirm that you are purchasing for lawful laboratory research only, and that you will not use, administer, or resell any product for human or animal use. We may refuse or cancel any order if we believe a product may be used outside this purpose.
2. Eligibility
- You must be at least 21 years old and legally able to enter into these Terms.
- You must be a qualified researcher, or purchasing on behalf of one, with the knowledge and facilities to handle research chemicals safely.
- You are responsible for complying with all laws that apply to you, including laws on purchasing, importing, possessing and handling research compounds where you live.
3. Your account
An account is created when you place your first order. You agree to give accurate information, keep your login details secure, and accept responsibility for all activity under your account. We may suspend or close accounts that break these Terms.
4. Orders and pricing
- Prices are in U.S. dollars and may change at any time before you place an order.
- Your order is an offer to buy. We may accept, decline or cancel any order, including for pricing or listing errors, stock availability, or suspected misuse or fraud. If we cancel a paid order, we will refund the amount paid.
- Product images and descriptions are for identification. Each Certificate of Analysis (COA) applies to the specific batch it names.
5. Payment
Payment is due in full at checkout using the payment methods shown. By placing an order, you authorize us to charge your chosen payment method for the order total, including any applicable taxes and shipping.
6. Shipping
Shipping methods, costs, processing times and delivery terms are set out in our Payment & Shipping policy. Delivery times are estimates, not guarantees.
7. Returns and refunds
Returns, refunds and claims are governed by our Return & Refund Policy. Due to the nature of our products, all sales are final except as stated in that policy.
8. Discount codes and the affiliate program
- Only one discount code can be used per order unless stated otherwise. Codes have no cash value and cannot be combined, transferred or exchanged.
- We may change or end any promotion at any time.
- Our affiliate program is governed by the Affiliate Terms.
9. Product information
Information on the Site, including product pages, certificates and the reconstitution calculator, is provided for laboratory research purposes only. It is not medical advice. We do not provide usage, dosing or administration guidance for people or animals.
10. Handling and assumption of risk
Research compounds must be handled only by trained persons, using appropriate safety equipment and procedures, and stored as directed. You assume all risks arising from the handling, storage, use and disposal of any product you buy.
11. Disclaimer of warranties
Except as expressly stated on the Site (such as the batch results shown on a COA), the Site and all products are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by law, Welltide will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from the misuse of any product. Our total liability for any claim relating to a product or order is limited to the amount you paid for that product.
13. Indemnification
You agree to indemnify and hold harmless Welltide and its owners, staff and partners from any claims, losses, damages and expenses (including reasonable legal fees) arising from your use or misuse of any product, your breach of these Terms, or your violation of any law or the rights of others.
14. Acceptable use of the Site
You may not use the Site for any unlawful purpose, attempt to interfere with its operation or security, scrape or copy its content, place fraudulent orders, or misrepresent your identity or purpose.
15. Intellectual property
All content on the Site, including text, images, logos and certificates, belongs to Welltide or its licensors and may not be copied or used without our written permission.
16. Privacy
Our Privacy Policy explains how we collect and use your personal information.
17. Governing law
These Terms are governed by the laws of the State of Washington, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Washington, and you consent to their jurisdiction.
18. Changes to these Terms
We may update these Terms at any time by posting a new version on this page with a new “Last updated” date. Your continued use of the Site or any new order means you accept the updated Terms.
